UK employers need to check that everyone they employ has the right to work in the UK.
To complete right to work checks for British and Irish nationals, employers must do one of the following:
- Meet with the employee and ensure that their documents are original, unaltered and belong to them
This means looking at the person and comparing them to the image on their passport to check if it does indeed match.
- Use a certified online Identification Service Provider (IDSP)
The IDSP will use Identification Document Verification Technology to check the passport of the British & Irish national matches the person using it. This technology asks the person to take videos of themselves moving, talking etc. for facial recognition. Certified IDSPs can be found on the UKAS website.
To complete right to work checks for non-British/Irish nationals, employers must do one of the following:
- Use the Home Office online right to work check
- Complete an in person check
- Use a certified Identification Service Provider (IDSP)
These checks must be carried out before a person starts their employment, and failure to carry out these checks could result in fines of up to £20,000 per employee.
If the employee or applicant cannot show their documents, you must contact the Employer Checking Service.
